This Privacy Statement explains how Ubi-Es Technologies, Inc. d/b/a Positio.Ai ("Positio.Ai", "we", "our", or "us") collects, uses, shares, and protects information when individuals use PositioGO™ applications, Positio Mobile SDK, Positio Experience Platform (PXP), Retailer mobile applications integrating the Positio SDK, Related websites, APIs, and services
This Privacy Statement applies to both Business users of Positio.Ai services and End users of retailer, brand, or partner mobile applications utilizing Positio technologies
1. OUR ROLE
Positio.Ai generally acts as a service provider, processor, or technology platform provider on behalf of retailers, brands, and partners. The retailer or mobile application provider remains responsible for:
consumer privacy notices, user consent collection, marketing permissions, loyalty program management and consumer communications. Where required by law, the retailer or application provider is the Data Controller and Positio.Ai acts as a Data Processor.
2. INFORMATION WE COLLECT
Depending upon deployment configuration, Positio products may collect: Account Information, user identifiers, loyalty account identifiers, account preferences and authentication information. Device Information such as device type, operating system, device model, application version, network information and mobile advertising identifiers where permitted by law. Location and Proximity Information which is subject to user permissions: GPS location, bluetooth Low Energy (BLE) proximity signals, sensor detections, beacon detections, store entry and exit events, zone visit events, aisle-level location events and product zone interactions. Positio technologies use location and proximity information to determine when mobile experiences, content, alerts, or coupons may be relevant to a user.
3. INFORMATION GENERATED BY POSITIO TECHNOLOGIES
Positio.Ai systems may create:
Visit Events: Store arrival ,Store departure, Dwell time and Store frequency. Zone Events: Zone entered, Zone exited and Duration within zone. Engagement Events: Notification sent, Notification viewed, Notification opened, Deep link launched. Coupon Events: Coupon viewed, Coupon clipped, Coupon activated and Coupon redeemed. Campaign Events: Impression tracking, Engagement tracking, Attribution tracking, Conversion tracking
4. HOW WE USE INFORMATION
Information may be used to for Service Delivery: operate Positio.Ai technologies, deliver location-based experiences, Trigger mobile notifications and provide coupon and campaign services. Analytics understand engagement trends, measure campaign effectiveness, produce attribution reporting and improve product performance. to enable security to monitor fraud, protect systems, detect unauthorized activity and enforce terms and policies. For product Improvement; improve SDK performance, improve mobile experiences, develop new features and optimize retail engagement systems.
5. MOBILE SDK INFORMATION
The Positio Mobile SDK may process the following information on behalf of an authorized retailer or partner: device identifiers, application identifiers, bluetooth detections, sensor detections, location information, event telemetry and campaign activity.
The SDK does not:
The SDK only operates according to permissions granted by the user and the hosting mobile application.
6. BLUETOOTH AND LOCATION SERVICES
Positio technologies rely on Bluetooth and location services to identify proximity to physical locations, products, departments, displays, or store zones. Users may disable: bluetooth access, location permissions and background location permissions through device settings.
Disabling such permissions may reduce or eliminate certain functionality.
7. COOKIES AND SIMILAR TECHNOLOGIES
Positio websites and services may use: cookies, pixels, local storage, SDK technologies and analytics technologies to improve service performance and user experience. Users may manage cookie preferences through browser settings where applicable.
8. SHARING OF INFORMATION
Positio.Ai may share information with: Authorized Customers including: retailers, brands, agencies and 3rd party platform operators that have contracted for the services. Service Providers including vendors providing: cloud hosting, analytics, security, communication services and technical support.
Legal Requirements; we may disclose information when required by the law, court order, government request and regulatory obligation. Corporate Transactions Information may be transferred in connection with a merger or acquisition, financing and sale of assets
9. DATA RETENTION
Information is retained only as long as reasonably necessary for: Service delivery, contractual obligations, security requirements, legal compliance and business operations. Retention periods vary based upon customer agreements and applicable law.
10. DATA SECURITY
Positio.Ai maintains commercially reasonable technical, administrative, and organizational safeguards designed to protect information against: Unauthorized access, accidental disclosure, alteration, misuse and loss. No system can guarantee absolute security. Users are encouraged to protect their credentials and devices.
11. INTERNATIONAL DATA TRANSFERS
Information may be processed in the United States and other jurisdictions where Positio.Ai or its service providers operate. Appropriate safeguards may be implemented where required by applicable data protection laws.
12. CHILDREN'S PRIVACY
The Services are not intended for children under the age required by applicable law. Positio.Ai does not knowingly collect personal information from children without appropriate authorization and legal basis.
13. CONSUMER PRIVACY RIGHTS
Depending upon jurisdiction, individuals may have rights to: Access information, correct information, delete information, restrict processing, object to processing, receive information in a portable format and withdraw consent. Requests should generally be submitted through the retailer or application provider with whom the individual has a relationship.
14. STATE PRIVACY RIGHTS
Residents of certain jurisdictions, including California, Colorado, Connecticut, Virginia, Texas, and other applicable states, may possess additional privacy rights under applicable laws. Positio.Ai will honor applicable rights requests as required by law.
15. DO NOT SELL OR SHARE
Positio.Ai does not sell personal information for monetary consideration.
Where applicable privacy laws define "sharing" broadly for advertising purposes, Positio.Ai will honor legally required consumer preferences and customer instructions.
16. SDK PARTNER RESPONSIBILITIES
Retailers and application providers integrating the Positio SDK must: Provide an appropriate privacy notice, obtain required user consents, obtain Bluetooth permissions, obtain location permissions, disclose location-based functionality and comply with applicable privacy laws. The hosting application remains responsible for its own privacy practices.
17. CHANGES TO THIS PRIVACY STATEMENT
We may update this Privacy Statement periodically. Updated versions will be posted with a revised Effective Date. Continued use of the Services after an update constitutes acceptance of the revised Privacy Statement.
